Our Approach To Contract Formation

Contracts formalise agreements by defining the terms and conditions under which goods, services or works are purchased.

Contracts impose legal obligations on each party to the contract. It is critical, therefore, that these contract obligations are clear, precise and unambiguous. Care and expertise is required in both their drafting and administration.

RR quantity surveyors assist and advise our Clients in the process of contract formation, including designing and operating effective procurement processes, negotiating and agreeing contract conditions, preparing contract documentation, including ancillary documentation such as collateral agreements, bonds, guarantees, etc.
RR project managers and quantity surveyors are involved in all aspects of contract administration from undertaking the formal role of Contract Administrator (Or Employer’s Representative), to undertaking the defined role of Quantity Surveyor to providing support and advice to Contract Administrators and Parties to contracts.
RR dispute advisors provide specialist services to support Clients who find themselves involved in disagreements and contractual disputes, on their projects.

Our team of Dispute Advisors include Quantity Surveyors and Engineers with qualifications and expertise in Construction Law and Contract Administration, and with significant experience assisting in dispute resolution processes on multiple project types and under varied contract arrangements. We can call on external specialist expertise in areas of forensic planning and delay analysis, as required.

Services provided include:
  • Preparation of submissions to Conciliations, Adjudications and Arbitrations;
  • Independent Risk Assessments;
  • Project Board Member (Public Works Contracts);
  • Conciliator Appointments;
  • Preparing Expert Witness Reports.

In addition to these defined services, our experienced team is frequently called on to provide “soft” services including informal advice on the strengths and weakness of claims and responses, to assist in negotiation and resolution of difficult contractual disagreements and disputes, and to act as informal mediator between parties to contracts when disagreements arise.

“Almost all contractual disputes can be avoided or resolved with a combination of ‘common sense’ and pragmatism provided these are deployed early enough.”
