Dispute avoidance and resolution services for construction and civil engineering projects.

Our dispute resolution team includes experienced construction professionals with specific construction law and dispute resolution qualifications, who are engaged as Conciliators, Adjudicators, Project Board Members, Risk Assessors, Expert Witnesses and Dispute Advocacy roles on construction and civil engineering projects.

Rogerson Reddan has more than 30 years' experience dealing with construction contracts and has, for the past 15 years, provided specialist dispute advisory services in relation to building projects, civil engineering projects, specialist subcontracts and professional appointments. We have advised and assisted in the resolution of disputes across the full range of contract types in use in Ireland, with particular emphasis on the public works suites of contracts.

Our disputes personnel are appointed in varying roles including as independent dispute resolver (Conciliator, Adjudicator, etc.), as project board members and as party advocate to support parties who find themselves involved in disputes.

 


Dispute Resolution services provided include:

Conciliator / Standing Conciliator

John Hughes is a qualified and SCSI Accredited Conciliator and is a panel member of both the SCSI and CIF Conciliators Panels. He has been appointed as both Standing Conciliator (under the PWC Contracts) and Conciliator under RIAI and PWC Contracts, successfully resolving disputes of up to €5m. 

Adjudication

Peter Walshe and John Hughes are members of the Minister’s Panel of Construction Adjudicators. In addition to appointments as Adjudicator, we undertake support and advisory services for parties involved in adjudications.

Project Boards

Rogerson Reddan provides qualified and experienced personnel to undertake the role of Project Board member under the PWC contracts. These appointments have allowed us to assist in the early resolution of many disputes, avoiding more formal and costly dispute resolution processes.

Dispute Advisor / Party Advocate

Rogerson Reddan is frequently engaged by parties (including some of Ireland’s largest public bodies) to assist and support them through the dispute process. These roles include contract documentation review; advice on contract claims / disputes provisions; drafting claims / responses; co-ordinating technical teams; undertaking role of Lead Advocate in dispute resolution proceedings.

Independent Risk Assessment

We undertake independent risk assessments of disputes and claims, at all stages of the dispute process, from early-stage negotiations, to conciliations, through to arbitrations. This role requires an ability to assimilate the issues in dispute and to anticipate the likely views of a third-party Conciliator / Adjudicator / Arbitrator.

Expert Witness

We are qualified to and provide expert witness reports and when required expert witness testimony in relation to matters in dispute which fall within our areas of competence. This service is typically required as part of arbitration / litigation processes.
